Sell Your Sacramento House As-Is

We Buy Houses in Their Current As-Is condition, No Warranties, No Contingencies Whatsoever.  Sell Your Sacramento House As-Is

Selling any house can be intimidating and extremely stressful especially when the house is in less than marketable condition. Let’s be clear there are a lot of houses that are in fair to poor condition and with the economy sputtering along, with wages stagnate or frozen, is there really any money left over to fix those many little items let alone home improvements?

It is the reason that so many homeowners of distressed properties have failed to sell a property that has had years of deferred maintenance or just fallen into disrepair. No one wants to take on the additional liability of selling a house that they could eventually be liable for.

The perceived onetime gain of selling a distressed property may not outweigh the long-term liability in selling the house.

In this article, we’re going to discuss how a homeowner can sell that distressed property without and ongoing liabilities whatsoever. We’re also going to explain why the liability of continuing to own that home carries more liability if they just kept it.

The Issue of Ownership

Ownership comes with responsibility and while it is not required that a home that is owned free and clear need to be insured, a homeowner that owns a house in California is liable for any damages, injuries or disabilities that his or her properties cause while they are the owner.

In this litigious society that we live in, your distressed house that causes sleepless nights may actually become someone else’s lottery ticket and you could lose everything you own. In California, it doesn’t matter whether the injured party is a tenant, trespasser, vandal, or tenant. If it is your property it is your responsibility to reasonably ensure that the property is secure and does not pose a threat to the public safety; No ifs, ands, or buts. And it doesn’t matter whether you have the money to fix the problem –  it is your responsibility.

Not only that but your house if left in a state of disrepair may also become the target for your city, town or Counties Code Enforcement Officer who will cite the property (you), fine the home owner (you again) and if you don’t cure the problem(s), they will pay someone else to fix the problem and send you the bill.

Think you are not going to pay it? Think again; it will become a tax lien on your property that will never disappear and that continue to grow with penalties and interest. I have actually seen property tax liens for Code violations exceed the value of the house. How is that for a non-performing asset?

Failing to do so is NOT Permitted unless the property is being sold in its “AS-IS” condition to an experienced Cash House Buyer or real estate investor like Westbrook REI.

By law, Sellers are required to disclose any known issues and/or defects regarding a house regardless of the outward appearance of the house in question. It is also assumed that the Seller must make all reasonable attempts to do so.

One Paragraph takes care of it all:

CONDITION OF THE HOUSE, MECHANICAL SYSTEMS & APPLIANCES: Buyer and seller agree that the Buyer is purchasing the House in its Current As-is Condition without regard for any defects and does so without any contingencies including the reliance on any statements made by the seller Whatsoever. Buyer and Seller agree that Buyer is experienced in the business of purchasing houses and enters into this agreement at its own choosing and does so at its own risk of loss. Buyer and Seller agree that Seller makes NO Warranties regarding the condition of the house whatsoever. Buyer and seller also agree that Seller makes no warranties regarding any mechanical systems, plumbing, electrical, sewer or that any appliances will be in good working order at closing. Buyer and seller agree that Buyer will have access to the property during the escrow period for inspection of which the cost of any inspection and or any needed repairs will be paid by Buyer at the Buyers Sole Expense.
